Our Dream of a Home on Koh Samui: A First-Hand Account

Do you dream of owning a home under the palm trees on a tropical island? We made that dream a reality and have made Koh Samui our home! Since September 2022, we've not only acquired our first house here but have expanded our property family to a total of four. How did we do it? In this post, we'll share our experiences—from the very first steps to choosing the right purchasing method and our lessons learned with lawyers and more.

 

The First Step: Acquiring a Company Limited

Our journey to owning property on Koh Samui began in September 2022. We acquired the existing Samui Dreamcatcher Co. Ltd., which at the time owned our first house in the Baan Ton Mai Resort in Khao Phra. So we didn't buy the house directly; we acquired the company that already owned the property.

Acquiring a company limited is a very common method for foreign investors, but it isn't the only way, nor is it necessarily the safest. It comes with complex legal and tax obligations. The safest methods for foreigners to acquire a property are typically through a Leasehold for houses and under the Condominium Act for apartments that fall within the so-called "foreigner quota." We chose this option to build our rental business, Samui Dreamcatcher.

This house in Khao Phra, along with two other properties—another house in Khao Phra and an apartment in Plai Laem—now forms the core of our business. These properties also have their own Company Limiteds. We consciously chose these locations because they offer a good balance between a peaceful setting and proximity to tourist hotspots.

Our Experience with Lawyers, Tax Advisors, and the Purchase Process

Acquiring a company limited is a complex legal process, and choosing the right lawyers and tax advisors is crucial. We quickly learned that a meticulous review of contracts and transparent communication are essential.

  • Real Estate Agent: It's absolutely vital to start your journey with a professional real estate agent. They should have all the sales documents ready and verified, cater their services to an international clientele, and ensure everything complies with Thai law. They should also create a precise timeline for the step-by-step purchase.
  • Legal Advice: We hired experienced local law firms that specialize in real estate law for foreigners, or for couples where one partner is Thai. This helped us avoid pitfalls.
  • Tax Advisor: A good tax advisor is essential to understand and correctly manage the tax aspects of the purchase and rental income according to Thai law.
  • Company Limited: The acquisition of such a company must be carefully planned. This includes proper documentation and compliance with all legal regulations, especially regarding the Thai co-shareholders who must be actively involved in the company. This was a good fit for us since my wife and daughter are Thai and are very actively involved in the business.

The Personal Dream: A Private Home in Ang Thong

After we acquired and renovated our first three rental properties, we turned our attention to our personal dream home. The fourth house we purchased is Baan Nk Yung in Ang Thong.

This house, which my wife acquired personally as a Thai citizen, is our private retreat. Ang Thong is still very "Thai" and has maintained its original charm. Here we are far from the tourist crowds and enjoy the authentic island life—the Samuian way of life. We feel very much at home there.
